  • This Privacy Policy describes the way The Contemporary Austin Museum, Inc. (aka The Contemporary Austin) (“we,” “our,” or “us”) may process your personal data or personally identifiable information, in each case, subject to protection under applicable data privacy laws (“Personal Information”) when you use or interact with our Laguna Gloria Nature & History Tours App (the “App”) and how we use, protect and disclose such Personal Information. A link to this policy is included in the App when you first download and access it, and at the following link: thecontemporaryaustin.org/listening-to-the-land-privacy-policy].

    This Privacy Policy applies to Personal Information collected, used, or otherwise processed through the App in connection with the Laguna Gloria Nature & History Tours (the “Exhibit”). It does not apply to information collected, used, or otherwise processed through our website, in-person visits, or other services unless otherwise stated.

    1. Personal Information We Collect, Use, or Otherwise Process

    When you use or interact with the App, we may collect or use the following types of Personal Information:

    Device information, such as IP address, device type, device metadata, operating system, app version, and anonymous identifiers automatically generated from your device.

    Geolocation information, including general geolocation data, such as an approximate location inferred from your IP address.

    If you consent, we also use and process your geolocation data, that captures (a) your approximate location, or (b) your precise real-time location data through GPS to trigger Exhibit features when you are near a specific location. Precise geolocation data is considered sensitive personal information. See Your Choices (Location services) for how to grant, decline, or revoke this consent.

    App usage data, such as which Exhibit features are accessed, how much time was spent at the Exhibit, and crash reports, stability metrics, and other crash data dumps automatically generated from the App.

     
    2. How We Use Your Personal Information

    We use your Personal Information to enhance your Exhibit experience and operate and improve our App, including to:

    Provide, maintain, and improve features in the App, including triggering location-based Exhibit features as you move through the museum.

    Monitor and improve the App’s performance, usability, and content, including bug fixes and maintenance.

    Analyze general user engagement and usage trends.

    Comply with legal or regulatory obligations, manage legal disputes, or respond to complaints or requests from governmental or other regulatory authorities.

    Identify and deter illegal, harmful, or unauthorized activity, including data security incidents, cyberattacks, and identity theft.
     
    3. Disclosure of Personal Information

    We may disclose your Personal Information in the following circumstances:

    Service providers: We may disclose your Personal Information with service providers to perform certain services on our behalf, such as IT service providers, suppliers, app developers, analytics providers and other vendors (including Mapbox and PostHog). For more information, see the Your Choices (Location services) and the PostHog privacy policy, available at https://posthog.com/privacy.

    Professional advisors: We may disclose your Personal Information with professional advisors, including accountants, auditors, consultants, and legal counsel, as necessary for business or compliance purposes

    Legal requirements: We may disclose your Personal Information when we reasonably believe such disclosure is required by law, when requested by a governmental authority, agency, regulator, or court, or if necessary to establish, exercise or defend legal claims, or to protect your, our or others’ rights, property or safety

    Business transferees: We may disclose your Personal Information in connection with a sale, merger, reorganization, dissolution, or other transfer of assets

    We do not sell your Personal Information or share Personal Information for marketing or commercial resale. Our third-party providers are contractually obligated to protect your data in accordance with this policy.
     
    4. Your Choices

    You have choices regarding the collection, use, and processing of your Personal Information:

    Location services: Upon installing and opening the App, we request your consent to access your precise geolocation data by enabling your device’s location permissions. If you disable location permissions, the App will still function and you may navigate the tour, but certain location-enabled App features, such as geofencing used to trigger Exhibit features, will not work. You can manage and enable or disable location permissions at any time through your device permissions.

    The App’s map and geofencing features are powered by Mapbox, a third-party mapping service. If you provide consent, Mapbox may collect, use, or otherwise process your precise geolocation data directly from your device to display the map and your position. Mapbox’s collection, use, processing, and protection of your location data is subject to its own privacy policy, available at https://www.mapbox.com/legal/privacy, which we encourage you to review. We are not responsible for the privacy practices or security measures of Mapbox.
     
    5. Personal Information Requests

    To the extent we collect, use, or otherwise process your Personal Information, you may: (a) request to know more about and access your Personal Information, (b) request deletion of your Personal Information, (c) request correction of inaccurate Personal Information, (d) request restriction of processing of your Personal Information in certain scenarios, and (e) in certain cases, object to the processing of your Personal Information for certain purposes. To exercise any of these rights, please email [email protected].

    For your protection, we may only implement requests with respect to the Personal Information associated with the particular email address you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.

    Please note that we may deny your request if permitted or required by appliable law, including, but not limited to, if retention of your Personal Information is required by law or regulation or if we cannot reasonably verify the authenticity of the request.
     
    6. Protection and Retention of Your Personal Information

    We use reasonable administrative, technical, and physical safeguards designed to protect your Personal Information.

    If you wish to remove the device identifier tied to your use of the App, you may delete the App from your device, but note that we may retain certain information for so long as required for our legitimate business and operational purposes, to perform contractual obligations, or as required or permitted by applicable law (e.g., to fulfill the purposes described in this Privacy Policy, improve and maintain the App, and satisfy any legal, accounting or reporting requirements), including retaining analytics data indefinitely to support ongoing analysis of user engagement.
     
    7. Children’s Privacy

    We do not knowingly collect, use, or otherwise process information from children under the age of 16 through the App. Children under the age of 18 should always ask parents/guardians for permission before providing Personal Information to any website or services online. We urge all parents/guardians to participate in their children’s use of mobile applications and ensure there are proper safeguards around their Personal Information while online.
     
    8. Changes to This Policy
    We may update this Privacy Policy from time to time. Updates will be posted at the URL link noted at the beginning of this Privacy Policy with a revised “Last Updated” date.
